Welcome to KaamWalah (“we”, “our”, “us”). These Terms and Conditions govern your use of our mobile application, website, and services. By accessing or using KaamWalah, you agree to be legally bound by these Terms. If you do not agree, please do not use our services.
1. Definitions
- “User” refers to any individual using the KaamWalah app to book services.
- “Service Provider” refers to any professional (plumber, electrician, cleaner, painter, carpenter, etc.) listed on KaamWalah.
- “Platform” refers to KaamWalah’s website, app, and related services.
2. Eligibility
You must be at least 18 years old to use KaamWalah. By registering, you confirm that you have the legal capacity to enter into these Terms.
3. User Obligations
- You must provide accurate and up-to-date information during registration and bookings.
- You are responsible for maintaining the confidentiality of your login credentials.
- You agree not to misuse the platform for fraudulent, illegal, or harmful activities.
4. Service Provider Obligations
- Service Providers must provide services honestly, safely, and with reasonable skill and care.
- Service Providers are independent contractors; KaamWalah is not their employer.
- Service Providers must comply with applicable laws, licenses, and permits.
5. Booking and Cancellation
- Users must confirm bookings in the app. Cancellation policies may vary by service type and will be shown at the time of booking.
- KaamWalah reserves the right to cancel a booking in case of fraud, safety concerns, or unavailability of Service Providers.
6. Payments, Settlements & Refunds
6.1 Collection & Custodial Holding
When a User makes an online payment for a booking (via UPI, card, or other online payment methods), the payment is collected by KaamWalah and credited to the platform’s custodial account or the User/Service workflow (the “KaamWalah Wallet”). Funds received by KaamWalah will be held until they are either:
- (a) disbursed to the Service Provider according to these Terms, or
- (b) refunded to the User in accordance with our refund policy.
Payment processor fees charged by third parties (e.g., gateway charges, bank fees) may be deducted as applicable.
6.2 Payment to Service Providers
- Workers can request withdrawal of their earnings anytime. Payments are processed instantly or within a few hours via UPI ID or provided bank details.
- Currently, KaamWalah does not charge any platform fees, GST, or other processing charges. The full payment made by the User is transferred to the Worker.
- No KYC verification is required at this stage; Workers are responsible for ensuring the accuracy of their UPI ID or bank details for receiving payments.
6.3 Refunds & Cancellation
- Users are not required to pay in advance. Payment is made only after the work is completed and confirmed by the User.
- Refunds (if applicable) are initiated immediately in case of cancellation or disputes, and the amount is credited back to the User’s original payment method.
6.4 Security Notice
- Do not give your phone to another person for setting up UPI or bank account details in the KaamWalah app. If another person adds their UPI or bank account on your behalf, the payments may be transferred to their account, and KaamWalah will not be responsible for such losses.
7. Ratings and Reviews
- Users may leave feedback for Service Providers. Reviews must be fair, genuine, and not abusive.
- KaamWalah may remove reviews that violate our guidelines.
8. Limitation of Liability
KaamWalah acts only as a facilitator. We are not responsible for:
- The quality, safety, or outcome of services provided by Service Providers.
- Any loss, damage, or injury arising during or after services.
- Delays, cancellations, or unavailability of Service Providers.
9. Intellectual Property
All logos, trademarks, content, and designs on KaamWalah are our property. You may not copy, reproduce, or distribute them without written consent.
10. Privacy
Your personal data is handled according to our Privacy Policy. By using KaamWalah, you consent to such processing.
11. Account Suspension and Termination
- We may suspend or terminate your account for violations of these Terms or illegal activity.
- You may delete your account at any time by contacting support. Deleting an account does not automatically refund any outstanding balances or reverse completed transactions.
12. Dispute Resolution
- In case of disputes between Users and Service Providers, KaamWalah may assist but is not legally liable for the service delivery itself.
- Disputes will first attempt mediation through our support team before legal action.
13. Governing Law
These Terms are governed by the laws of India. Jurisdiction for disputes lies with the courts in Katihar, Bihar.
14. Changes to Terms
KaamWalah may update these Terms at any time. Users will be notified of significant changes via the app or website. Continued use implies acceptance of revised Terms.
